In Iowa a DBA is called “trade name”, and it can only be filed by individuals (sole proprietorships) or general partnerships. Corporations or limited liability companies organized in this state or authorized to do business in this state do not file for a trade name.
For sole proprietors a trade name must be different from their own true surname. A trade name essentially informs the public “who” they are doing business with but registering does not create any proprietary rights in the name.
Trade name is registered by filing an application with the county recorder in the county where the business is located (and not with Secretary of State’s Office). The fee to file a trade name varies depending on the county. Application must be notarized prior to filing.
